Regular Council Meeting

The Town of Wisner Mayor Marc McCarty and Board of Alderman met in regular session on Monday, January 7, 2019 at 6:30 P.M. at Wisner Town Hall.

Present: Mayor Marc McCarty, Alderman Elliot Britt, Nettie Brown, Jo Caldwell, Roger Hilliard, and Thomas Lemle

Call to Order: There being a quorum, Mayor Marc McCarty called the meeting proceedings to order. Invocation was given by Brother Thomas Peoples and the Pledge of Allegiance led by Thomas Lemle.

Approval of Minutes: Motion by Thomas Lemle, seconded by Nettie Brown to accept minutes from the previous month. Motion carried.

Approval of Financial Reports: Discussion held. Nettie Brown made a motion, seconded by Thomas Lemle to approve financial expenditures as presented. Motion carried.

Departmental Reports:

Fire – Report read by David Wallace Jr.

Police – Police Chief Billy Beach gave report. Chief Beach made a recommendation to hire Ladarius Frazier as a commissioned patrol officer on a 90-day probationary period. Discussion held. Motion made by Jo Caldwell, seconded by Nettie Brown to hire Ladarius Frazier as a commissioned patrol officer. Motion carried.

Public Works – Report given by Mayor Marc McCarty.

SPECIAL COUNCIL MEETING MINUTES

JANUARY 3, 2019

The Mayor and Council of the Village of Baskin met in special session on Thursday, January 3, @ 5 p.m. at the Village of Baskin Town Hall.

Present: Mayor Robert “Bobby” Fife and Council members Cary Collier, Johnny “Red” Belton and Heather Chapman.

Also present: Assistant Town Clerk and others.

There being a quorum present, the meeting was called to order.

The Pledge of Allegiance and the opening prayer was led by Mayor Robert “Bobby” Fife.

New Business:

Protocol for special meetings (how to notify the alderman) was discussed and said that the Mayor would call by phone to notify each alderman. 3 Yeas, 0 Nays and ) Absent.

A discussion was held to set time and date for regular council meetings. Council meeting will be held every second Tuesday of the month at 6:00 p.m. 3 Yeas, 0 Nays, and 0 Absent.

A new Fire Chief, Sammy Burns, was appointed by the council and his salary was set. 3 Yeas, 0 Nays, and 0 Absent.

The Franklin Sun was chosen as the Official Journal for the Village of Baskin. 3 Yeas, 0 Nays, and 0 Absent.

Council members discussed a Mayor Pro Tempore and chose Alderman Cary Collier to fill this position.

The Mayor and Mayor Pro Tempore are authorized to sign all check and bank documents. 3 Yeas, 0 Nays, and 0 Absent.

Mayor Fife recommended Danny Barber to be the new Maintenance Personnel. All council members were in favor of this recommendation. 3 Yeas, 0 Nays, and 0 Absent.

The salary for the Mayor, Police Chief and Alderman was discussed and set by the council members. 3 Yeas, 0 Nays, 0 Absent.

Merlyn Ritchie was appointed by the council as Town Clerk. 3 Yeas, 0 Nays, 0 Absent.

Mayor Fife recommended to the council that the Town Clerk, Merlyn Ritchie, be the administrator and handle all bank transaction. In the absence of the Town Clerk, the Assistant Clerk, Wanda Carroll would handle these duties. All council members were in favor. 3 Yeas, 0 Nays, 0 Absent.

Caroline Hemphill was chosen as the Attorney for the Village of Baskin. 3 Yeas, 0 Nays, 0 Absent.

Town Clerk Merlyn Ritchie was appointed as the Tax Collector for the Village of Baskin. 3 Yeas, 0 Nays, and 0 Absent.

REGULAR COUNCIL MEETING MINUTES

JANUARY 8, 2019

The Mayor and Council of the Village of Baskin met in regular session on Tuesday, January 8, 2019, 5:00 p.m. at the Village of Baskin Town Hall.

Present: Mayor Bobby Fife and Council members Cary Collier, Johnny Belton, and Heather Chapman.

Also present: Town Clerk and others.

There being a quorum present, the meeting was called to order.

The Pledge of Allegiance and the opening prayer was led by Mayor Fife.

Minutes: The minutes of the previous council meeting were presented by the clerk. Johnny Belton moved to approve the minutes as presented. Heather Chapman seconded the motion. The motion and second were approved. Yeas 3, Nays 0.

Right to Speak: Joe Walters, Franklin Parish Sales Tax Collector spoke to the council telling what his role is for the municipalities in the parish. He shared information important for us to know about revenue from sales tax.

New Business:

Financial Report:

A motion and second was made to pay all bills and obligations. Cary Collier moved; Heather Chapman seconded the motion. The action was approved. Yeas 3, Nays 0.

Discuss and set salaries for employees.

Maintenance Director salary was discussed and agreed upon. This position is a 40 hour, fiver days each week, Monday through Friday, full-time position. Heather Chapman moved to approve the salary; Cary Collier seconded and the decision was approved. Yeas 3, Nays 0.

The Town Clerk salary was addressed and agreed upon. Cary Collier moved and Heather Chapman seconded the motion to approve an increase in the clerks salary. The motion and second carried. Yeas 3, Nays 0.

The Assistant Clerk salary was decided and approved the motion and second by the following council members consecutively, Johnny Belton and Heather Chapman. Yeas 3, Nays 0.

Police Report:

Chief Roger Grayson gave the Monthly Activity Report. He made a request to the council to hire two part-time officers. Arthur Johnson and Jeremy Johnston. Salary and qualifications were discussed. Heather Chapman moved; Cary Collier seconded the motion to hire them as patrolmen and the decision passed. Yeas 3, Nays 0.

Chief Grayson also asked to change Mitch Davis from part-time to full-time patrolman with an increase in his salary and also included in the request was an increase in pay for long term employee, Kraig Gwin. Heather Chapman and Johnny Belton seconded the motion. The action was approved. Yeas 3, Nays 0.

The Chief also asked the council to consider new uniforms for the patrolmen. His suggestion was to change to navy polo shirts and navy pants. Cary Collier moved and Heather Chapman seconded the motion to purchase the new uniforms. Yeas 3, Nays 0. The action was approved.

Fire Department Report:

Fire Chief Sammy Burns, recently hired, shared some of this thoughts for going forth with the Volunteer Fire Department. He received the PIAL questionnaire yesterday which will be returned soon. A survey will be scheduled soon after the information is returned. It was also reported that some maintenance was needed on some of the vehicles.

Further Business:

An Ordinance to Amend Ordinance 06-05, Ordinance to Change the Regular Council meeting time was introduced. It will be presented for adoption on the 12th day of February, 2019 during the regular council meeting at the Village of Baskin Town Hall. Heather Chapman moved that the introduction be approved. Johnny Belton seconded the motion and the action was approved. Yeas 3, Nays 0.

After completing the business at hand, Mayor Fife called for a motion to close the meeting. Johnny Belton moved that the meeting end. Heather Chapman seconded the motion and the meeting was adjourned.

RESOLUTION

A resolution providing for canvassing the returns and declaring the result of the special election held in Franklin Parish Fire Protection District No. 2, State of Louisiana, on Saturday, December 8, 2018, to authorize the levy of a special tax therein.

BE IT RESOLVED by the Board of Commissioners of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “Governing Authority”), acting as the governing authority of Franklin Parish Fire Protection District No. 2, State of Louisiana, that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in Franklin Parish Fire Protection District No. 2, State of Louisiana, on SATURDAY, DECEMBER 8, 2018, to authorize the levy of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Franklin, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

This resolution having been submitted to a vote, the vote thereon was as follows:

PROCÈS VERBAL AND PROCLAMATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD IN FRANKLIN PARISH FIRE PROTECTION DISTRICT NO. 2, STATE OF LOUISIANA, ON SATURDAY, DECEMBER 8, 2018.

BE IT KNOWN AND REMEMBERED that on Tuesday, January 8, 2019, at six-thirty o’clock (6:30) p.m., at its regular meeting place, the Fort Necessity Fire Station, Fort Necessity, Louisiana, the Board of Commissioners of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “Governing Authority”), acting as the governing authority of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “District”), and being the authority ordering the special election held therein on Saturday, December 8, 2018, with the following members present:

There being absent: ___Gerald Gilmore________________________;

did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following proposition, to wit:

PROPOSITION

(MILLAGE RENEWAL)

Shall Franklin Parish Fire Protection District No. 2, State of Louisiana (the “District”), levy a tax of ten and fifty-three hundredths (10.53) mills on all property subject to taxation in the District (an estimated $157,950 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2021 and ending with the year 2030, for the purpose of acquiring, constructing, improving, maintaining and operating fire protection facilities and equipment for the District and paying the cost of obtaining water for fire protection purposes?

There was found by said count and canvass that there was a total of 147 votes cast IN FAVOR OF the Proposition and a total of 100 votes cast AGAINST the Proposition, as hereinabove set forth, as hereinabove set forth, and it was further found and determined that there was a majority of 47 votes cast IN FAVOR OF the Proposition as hereinabove set forth.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the District on Saturday, December 8, 2018.

Results by precinct are available from the Secretary of this Governing Authority during regular business hours or via the Louisiana Secretary of State’s website (voterportal.sos.la.gov).

Exhibit “A” attached hereto and made a part of this Procès Verbal is a copy of the Notice of Special Election and proof of publication thereof.

NOTICE OF SPECIAL ELECTION

Pursuant to the provisions of a resolution adopted by the Board of Commissioners of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “Governing Authority”), acting as the governing authority of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “District”), on June 12, 2018, NOTICE IS HEREBY GIVEN that a special election will be held within the District on SATURDAY, DECEMBER 8, 2018, and that at the said election there will be submitted to all registered voters in the District qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following proposition, to-wit:

The polling places at the precincts set forth above are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.

Notice is further given that a portion of the monies collected from the tax described in the Proposition shall be remitted to certain state and statewide retirement systems in the manner required by law.

The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Fort Necessity Fire Station, Fort Necessity, Louisiana, on TUESDAY, JANUARY 8, 2019, at SIX-THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election. All registered voters of the District are entitled to vote at said special election and voting machines will be used.

I, the undersigned Chairman of the Board of Commissioners of Franklin Parish Fire Protection District No. 2, State of Louisiana , the governing authority of Franklin Parish Fire Protection District No. 2, State of Louisiana (the “District”), do hereby declare, proclaim and announce that the proposition submitted at the special election held in the District on Saturday, December 8, 2018, was CARRIED by a majority of the votes cast at the said special election, all as described and set out in the above Procès Verbal.
